Kids Concept — Professional placement agency for nannies and childcare in Munich.
These General Terms and Conditions (T) apply exclusively to contractual relationships between the caregiver and KidsConcept.

Preamble
The company Kids Concept, owner Mr. Tobias Dreilich, Dr.-Max Straße 45, 82031 Grünwald, (hereinafter referred to as “Kids Concept”) operates a placement agency on the internet at the URL www.kidsconcept.de for services such as childcare, babysitters, childminders, nannies, substitute grandmothers, and childcare workers and educators, and establishes the connection between service providers (hereinafter caregivers) and clients (private households and companies).
1. Scope of Application
1.1 These General Terms and Conditions (T) apply exclusively to contractual relationships between the caregiver and KidsConcept.
1.2 General terms and conditions of the caregiver do not apply in this context, regardless of whether KidsConcept expressly objects to them.
1.3 The T also apply to contracts concluded with partners from countries other than Germany.
2. Conclusion of Contract / Registration as Caregiver
2.1 The contract is concluded upon signature of the parties on the application form.
2.2 Before concluding the agreement on registration as a caregiver, the caregiver must provide KidsConcept with the required data and documents. This can be done, among other ways, by completing the non-binding caregiver questionnaire on the Kids Concept website at www.kids-concept.de. The application documents must be complete and include, in particular, certificates, references, and a police clearance certificate.
2.3 After reviewing the documents and data and conducting a personal interview, Kids Concept decides whether the respective caregiver will be accepted into the agency or not.
2.4 Kids Concept is under no obligation to accept a caregiver into its agency.
3. Rights and Obligations of the Caregiver
3.1. The caregiver is obligated to provide Kids Concept with all documents and data relevant to a placement. Should special documents such as medical certificates, work visas, or driver’s licenses be required in individual cases, these must also be submitted to Kids Concept.
3.2 The caregiver must ensure that their information/documents are complete and accurate.
3.3. The caregiver is obligated to inform Kids Concept immediately of a successful placement.
4. Rights and Obligations of Kids Concept
4.1 Kids Concept is entitled to verify the documents and data provided by the caregiver. This includes, in particular, the right to consult with the issuers of the documents/references.
4.2 Kids Concept is under no obligation to place the caregiver.
5. Costs
5.1 Registration as a caregiver with Kids Concept is free of charge.
6. Termination
6.1 The agreement on registration as a caregiver may be terminated by either party at any time without observing a notice period.
7. Liability
7.1 Kids Concept assumes no liability for indirect or direct damages, unless they are based on intent or gross negligence. This limitation of liability also extends to the liability of employees, legal representatives, and vicarious agents of Kids Concept. Liability based on characteristics/guarantees assured by Kids Concept or based on product liability remains unaffected.
7.2. Kids Concept’s liability for simple negligence in principle is assumed extra-contractually only insofar as it concerns the breach of obligations whose fulfillment enables the proper performance of the contract in the first place, whose breach jeopardizes the achievement of the contractual purpose, and on whose compliance the partner regularly relies (so-called cardinal obligations). Insofar as it concerns the breach of such contractually essential obligations, liability for indirect damages, in particular loss of profit and consequential damages, is excluded.
7.3. Kids Concept’s liability is further limited to damages typical of the contract that were foreseeable at the time of contract conclusion and are not controllable by Kids Concept. Liability for such damages is limited in amount to the typically foreseeable damage.
7.4. The above limitations of liability do not apply in the event of injury to life, body, or health. Liability under the Product Liability Act remains unaffected.
8. Data Protection
8.1 Kids Concept undertakes to comply with the applicable data protection regulations, in particular the provisions of the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG).
8.2 Kids Concept is entitled, during the term of this contract, to collect, store, process, and use the data received in connection with the business relationship with the caregiver, to the extent necessary for the fulfillment of contractual obligations, in particular for the placement of assignments.
8.3 The caregiver has the right under the Federal Data Protection Act to free information about the data stored about them and, if applicable, a right to correction, blocking, and deletion of this data.
8.4 Any further use of personal data beyond the aforementioned use requires the separate consent of the caregiver. The caregiver is entitled to revoke their consent at any time, insofar as they have consented to the use of personal data. The revocation must be sent to Kids Concept, owner Mr. Tobias Dreilich, Dr.-Max Straße 45, 82031 Grünwald.
9. Indemnification
The caregiver indemnifies Kids Concept from all claims and holds Kids Concept harmless from such claims that third parties assert against Kids Concept due to the violation of their rights or due to legal violations based on the data/documents provided by the caregiver or due to conduct within the scope of the mediated service contract. In this regard, the caregiver also assumes the costs of the necessary legal defense of Kids Concept, including all court and attorney fees.
10. Other Provisions
10.1 The law of the Federal Republic of Germany applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
10.2 The place of jurisdiction for disputes arising from the contract is agreed between the parties to be the registered office of Kids Concept if
- The caregiver has no general place of jurisdiction in Germany
- the caregiver’s place of residence or habitual residence is unknown at the time the action is filed, or
- the caregiver has moved their place of residence or habitual residence abroad after conclusion of the contract.
