The com\u00adpa\u00adny Kids Con\u00adcept, owned by Mr. Tobi\u00adas Drei\u00adlich, Dr.-Max Stra\u00ad\u00dfe 45, 82031 Gr\u00fcn\u00adwald, (her\u00adein\u00adaf\u00adter refer\u00adred to as \u201cKids Con\u00adcept\u201d) ope\u00adra\u00adtes a pla\u00adce\u00adment agen\u00adcy on the inter\u00adnet at the URL https:\/\/kids-concept.de for ser\u00advices such as child\u00adca\u00adre, child\u00admin\u00adders, nan\u00adnies, as well as nur\u00adsery nur\u00adses and edu\u00adca\u00adtors, and estab\u00adlishes the con\u00adnec\u00adtion bet\u00adween ser\u00advice pro\u00advi\u00adders (her\u00adein\u00adaf\u00adter refer\u00adred to as care\u00adgi\u00advers) and cus\u00adto\u00admers (for pri\u00adva\u00adte house\u00adholds and com\u00adpa\u00adnies).<\/p>

1. Scope of Application<\/strong><\/h3>

The\u00adse Gene\u00adral Terms and Con\u00addi\u00adti\u00adons (GTC) app\u00adly exclu\u00adsi\u00adve\u00adly to con\u00adtrac\u00adtu\u00adal rela\u00adti\u00adonships estab\u00adlished bet\u00adween the cus\u00adto\u00admer and Kids Con\u00adcept via the ser\u00advice por\u00adtal at www.kids-concept.de. The\u00adse are incor\u00adpo\u00adra\u00adted into the con\u00adtract via a so-cal\u00adled click-wrap agree\u00adment and are accept\u00aded by the cus\u00adto\u00admer through a dou\u00adble opt-in email and sub\u00adse\u00adquent con\u00adfir\u00adma\u00adti\u00adon via an acti\u00adva\u00adti\u00adon link. Our GTC can be acces\u00adsed online at any time. <\/p>

2. Content of the Placement Agreement<\/strong><\/h3>

2.1 The con\u00adtent of the con\u00adtract con\u00adcluded bet\u00adween the cus\u00adto\u00admer and Kids Con\u00adcept is the paid pla\u00adce\u00adment acti\u00advi\u00adty. The ser\u00advice con\u00adtract (care agree\u00adment) sub\u00adse\u00adquent\u00adly con\u00adcluded bet\u00adween the cus\u00adto\u00admer and the care\u00adgi\u00adver is not part of the pla\u00adce\u00adment agree\u00adment. In par\u00adti\u00adcu\u00adlar, Kids Con\u00adcept is not respon\u00adsi\u00adble for pro\u00advi\u00adding the child\u00adca\u00adre ser\u00advices. <\/p>

This care agree\u00adment, which exists exclu\u00adsi\u00adve\u00adly bet\u00adween the cus\u00adto\u00admer and the care\u00adgi\u00adver, is neither pro\u00advi\u00added, desi\u00adgned, nor review\u00aded for con\u00adtent by Kids Con\u00adcept. Kids Con\u00adcept is the\u00adr\u00ade\u00adfo\u00adre not obli\u00adged to ensu\u00adre com\u00adpli\u00adance with the legal requi\u00adre\u00adments and obli\u00adga\u00adti\u00adons exis\u00adting for the care agree\u00adment. <\/p>

In par\u00adti\u00adcu\u00adlar, Kids Con\u00adcept is the\u00adr\u00ade\u00adfo\u00adre not respon\u00adsi\u00adble for<\/p>

  • com\u00adpli\u00adance with spe\u00adci\u00adfic tax, labor, social secu\u00adri\u00adty, and\/or immi\u00adgra\u00adti\u00adon regu\u00adla\u00adti\u00adons (within the frame\u00adwork of the care agree\u00adment)<\/li>
  • the con\u00adclu\u00adsi\u00adon of health, acci\u00addent, lia\u00adbi\u00adli\u00adty, and\/or other insu\u00adrance poli\u00adci\u00ades (within the frame\u00adwork of the care agree\u00adment)<\/li><\/ul>

    2.2 After the con\u00adclu\u00adsi\u00adon of the pla\u00adce\u00adment agree\u00adment, Kids Con\u00adcept will offer the cus\u00adto\u00admer up to 5 care\u00adgi\u00advers who meet the cus\u00adto\u00admer\u2019s requi\u00adre\u00adments for pla\u00adce\u00adment.<\/p>

    The cor\u00adre\u00adspon\u00adding docu\u00adments will gene\u00adral\u00adly only be sent after the can\u00adcel\u00adla\u00adti\u00adon peri\u00adod has expi\u00adred, unless the cus\u00adto\u00admer has excep\u00adtio\u00adnal\u00adly reques\u00adted an \u201cexpress\u201d deli\u00advery.<\/p>

    2.3 If the cus\u00adto\u00admer deci\u00addes on one of the offe\u00adred care\u00adgi\u00advers, they must con\u00adclude a cor\u00adre\u00adspon\u00adding ser\u00advice con\u00adtract (her\u00adein\u00adaf\u00adter refer\u00adred to as the care agree\u00adment) with them. This con\u00adtract is con\u00adcluded sole\u00adly bet\u00adween the cus\u00adto\u00admer and the care\u00adgi\u00adver \u2013 Kids Con\u00adcept its\u00adelf is not a par\u00adty to it. <\/p>

    2.4 If the cus\u00adto\u00admer wis\u00adhes for a pre\u00adce\u00adding tri\u00adal peri\u00adod befo\u00adre con\u00adclu\u00adding a care agree\u00adment, they must inform Kids Con\u00adcept. Kids Con\u00adcept will then cont\u00adact the respec\u00adti\u00adve care\u00adgi\u00adver and endea\u00advor to arran\u00adge such a tri\u00adal peri\u00adod. Unless other\u00adwi\u00adse agreed, the pro\u00advi\u00adsi\u00adons of Sec\u00adtion 7 of the\u00adse GTC app\u00adly to the use of tri\u00adal peri\u00adods. <\/p>

    2.5 In the event that the care\u00adgi\u00adver is unavailable due to pro\u00adlon\u00adged ill\u00adness, fails to appear, or the con\u00adtrac\u00adtu\u00adal rela\u00adti\u00adonship is ter\u00admi\u00adna\u00adted within 3 months of the con\u00adclu\u00adsi\u00adon of the pla\u00adce\u00adment agree\u00adment, the cus\u00adto\u00admer will be offe\u00adred up to 3 new can\u00addi\u00adda\u00adtes for pla\u00adce\u00adment by Kids Con\u00adcept once, wit\u00adhout incur\u00adring fur\u00adther pro\u00adces\u00adsing or pla\u00adce\u00adment fees.<\/p>

    After the 3\u2011month peri\u00adod has expi\u00adred or in the event that new can\u00addi\u00adda\u00adte pro\u00adfiles have alre\u00ada\u00addy been pre\u00adsen\u00adted, the cus\u00adto\u00admer must enter into a new pla\u00adce\u00adment order with Kids Con\u00adcept.<\/p>

    2.6. The cus\u00adto\u00admer under\u00adta\u00adkes to inform Kids Con\u00adcept if the employ\u00adment con\u00adtract is modi\u00adfied and more hours than pre\u00advious\u00adly sta\u00adted are work\u00aded. Accor\u00addin\u00adgly, the respec\u00adti\u00adve pla\u00adce\u00adment com\u00admis\u00adsi\u00adon will then also chan\u00adge. <\/div>

    3. Conclusion of the Placement Agreement<\/strong><\/h3>

    3.1 The pla\u00adce\u00adment order for a ser\u00advice is pla\u00adced via the respec\u00adti\u00adve appli\u00adca\u00adti\u00adon forms pro\u00advi\u00added to the cus\u00adto\u00admer within the ser\u00advice por\u00adtal www.kids-concept.de.<\/p>

    3.2 The data reques\u00adted in the cor\u00adre\u00adspon\u00adding order form must be pro\u00advi\u00added com\u00adple\u00adte\u00adly and cor\u00adrect\u00adly by the cus\u00adto\u00admer. The cus\u00adto\u00admer is respon\u00adsi\u00adble for the com\u00adple\u00adten\u00adess and accu\u00adra\u00adcy of this infor\u00adma\u00adti\u00adon. <\/p>

    By cli\u00adcking the \u201cSend Order\u201d but\u00adton, the cus\u00adto\u00admer sub\u00admits a bin\u00adding offer to con\u00adclude a pla\u00adce\u00adment agree\u00adment regar\u00adding the reques\u00adted ser\u00advice. They will then recei\u00adve a con\u00adfir\u00adma\u00adti\u00adon email con\u00adfir\u00adming the receipt of the order by Kids Con\u00adcept. It will be declared to the cli\u00adent that the con\u00adtract has been accept\u00aded. <\/p>

    3.4 The cus\u00adto\u00admer has no cla\u00adim to the con\u00adclu\u00adsi\u00adon of a pla\u00adce\u00adment agree\u00adment or to the pla\u00adce\u00adment its\u00adelf.

    4. Right of Withdrawal<\/strong><\/h3>

    5. Costs \/ Payment Terms<\/strong><\/h3>

    5.1 For a suc\u00adcessful pla\u00adce\u00adment, the cus\u00adto\u00admer must pay the agreed pla\u00adce\u00adment fee to Kids Con\u00adcept. This is based on the curr\u00adent\u00adly valid pri\u00adce list for pla\u00adce\u00adments, which is made available to the cus\u00adto\u00admer befo\u00adre the order is pla\u00adced.<\/p>

    5.2 In addi\u00adti\u00adon, the cus\u00adto\u00admer must pay a pro\u00adces\u00adsing fee of \u20ac250.00 (incl. VAT) for the sel\u00adec\u00adtion and for\u00adwar\u00adding of sui\u00adta\u00adble care\u00adgi\u00advers. In the event of a suc\u00adcessful pla\u00adce\u00adment and the con\u00adclu\u00adsi\u00adon of a care agree\u00adment, this will be cre\u00addi\u00adted in full towards the pla\u00adce\u00adment fee accor\u00adding to Sec\u00adtion 5.1. <\/p>

    5.3 Unless other\u00adwi\u00adse agreed, the cus\u00adto\u00admer will recei\u00adve an invoice from Kids Con\u00adcept after the con\u00adtract has been pro\u00adces\u00adsed.<\/p>

    The pla\u00adce\u00adment com\u00admis\u00adsi\u00adon beco\u00admes due as soon as we have the signed con\u00adtract bet\u00adween the nan\u00adny and the fami\u00adly.<\/p>

    Howe\u00adver, if the cus\u00adto\u00admer has expli\u00adcit\u00adly reques\u00adted an \u201cexpress\u201d deli\u00advery of the data when pla\u00adcing the order, the pro\u00adces\u00adsing fee of \u20ac250.00 (incl. VAT) must be paid in advan\u00adce.<\/p>

    7. Right of Withdrawal
    <\/strong><\/h3>

    7.1 The con\u00adfir\u00adma\u00adti\u00adon email after with\u00addra\u00adwal is the legal\u00adly requi\u00adred con\u00adfir\u00adma\u00adti\u00adon of receipt accor\u00adding to \u00a7356 para. 1 BGB \u2014 no dou\u00adble opt-in, no fur\u00adther step requi\u00adred by the cus\u00adto\u00admer. <\/p>

    7.2 The with\u00addra\u00adwal is legal\u00adly effec\u00adti\u00adve upon sen\u00adding the form (\u00a7355 BGB).<\/p>

    7.3 The can\u00adcel\u00adla\u00adti\u00adon poli\u00adcy its\u00adelf must be available sepa\u00adra\u00adte\u00adly on the web\u00adsite \u2014 not part of the con\u00adfir\u00adma\u00adti\u00adon email.

    7.4 Details regar\u00adding the refund (amount, peri\u00adod, pay\u00adment method) will be com\u00admu\u00adni\u00adca\u00adted indi\u00advi\u00addu\u00adal\u00adly by the Kids Con\u00adcept team via a sepa\u00adra\u00adte email, as the scope varies depen\u00adding on the sta\u00adtus of the order.

    7.5 Your right of with\u00addra\u00adwal expi\u00adres pre\u00adma\u00adtu\u00adre\u00adly if the con\u00adtract has been ful\u00adly per\u00adfor\u00admed by both par\u00adties at your express request befo\u00adre you have exer\u00adcis\u00aded your right of with\u00addra\u00adwal.<\/p>

    8. Regulations for Trial Periods<\/strong><\/h3>

    8.1 In the event that the care\u00adgi\u00adver has agreed to per\u00adform a tri\u00adal peri\u00adod, the fol\u00adlo\u00adwing regu\u00adla\u00adti\u00adons app\u00adly, unless other\u00adwi\u00adse agreed in excep\u00adtio\u00adnal cases.<\/p>

    8.2 The tri\u00adal days must be taken within one month befo\u00adre the con\u00adtract is signed and are limi\u00adt\u00aded in time as fol\u00adlows:<\/p>

    • Part-time child\u00adca\u00adre (up to 25 hours) \u2014 1 tri\u00adal day<\/li>
    • Part-time child\u00adca\u00adre (up to 35 hours) \u2014 2 tri\u00adal days<\/li>
    • Nur\u00adsery nur\u00adse or edu\u00adca\u00adtor (full-time) \u2013 3 tri\u00adal days<\/li><\/ul>

      8.3 To avo\u00adid unneces\u00adsa\u00adry wai\u00adting times in admi\u00adnis\u00adtra\u00adti\u00adon, the cus\u00adto\u00admer under\u00adta\u00adkes to com\u00admu\u00adni\u00adca\u00adte a decis\u00adi\u00adon regar\u00adding the con\u00adti\u00adnua\u00adtion or rejec\u00adtion of the care imme\u00addia\u00adte\u00adly, but no later than five days after the end of the tri\u00adal peri\u00adod. If the cus\u00adto\u00admer deci\u00addes on a can\u00addi\u00adda\u00adte from Kids Con\u00adcept, a time\u00adly con\u00adtract con\u00adclu\u00adsi\u00adon within 2 weeks must be obser\u00adved. <\/p>

      9. Confidentiality \/ Contractual Penalty<\/strong><\/h3>

      9.1 All data pro\u00advi\u00added by Kids Con\u00adcept regar\u00adding the can\u00addi\u00adda\u00adtes (e.g., appli\u00adca\u00adti\u00adon docu\u00adments, address, tele\u00adpho\u00adne num\u00adber, and email address) are inten\u00added only for the respec\u00adti\u00adve cus\u00adto\u00admer and must be trea\u00adted as strict\u00adly con\u00adfi\u00adden\u00adti\u00adal. The cus\u00adto\u00admer is not per\u00admit\u00adted to pass this data on to third par\u00adties in any form wit\u00adhout the express con\u00adsent of Kids Con\u00adcept or the care\u00adgi\u00adver them\u00adsel\u00adves. <\/p>

      9.2 In the event of a vio\u00adla\u00adti\u00adon, a con\u00adtrac\u00adtu\u00adal penal\u00adty in the amount of \u20ac4,000.00 may be asser\u00adted against the cus\u00adto\u00admer. Fur\u00adther claims for addi\u00adtio\u00adnal dama\u00adges remain unaf\u00adfec\u00adted by this. <\/p>

      10. General Liability<\/strong><\/h3>

      10.1 Kids Con\u00adcept assu\u00admes no lia\u00adbi\u00adli\u00adty for the accu\u00adra\u00adcy and truthful\u00adness of the infor\u00adma\u00adti\u00adon regar\u00adding the care\u00adgi\u00advers. In par\u00adti\u00adcu\u00adlar, Kids Con\u00adcept assu\u00admes no gua\u00adran\u00adtee for the actu\u00adal qua\u00adli\u00adfi\u00adca\u00adti\u00adon or sui\u00adta\u00adbi\u00adli\u00adty of the pre\u00adsen\u00adted care\u00adgi\u00advers. The care\u00adgi\u00advers them\u00adsel\u00adves are sole\u00adly respon\u00adsi\u00adble for the\u00adse. <\/p>

      Kids Con\u00adcept assu\u00admes no lia\u00adbi\u00adli\u00adty for dama\u00adges resul\u00adting from the pla\u00adce\u00adment acti\u00advi\u00adty, pro\u00advi\u00added the\u00adse are not based on intent or gross negli\u00adgence. This exclu\u00adsi\u00adon of lia\u00adbi\u00adli\u00adty also extends to the lia\u00adbi\u00adli\u00adty of employees, legal repre\u00adsen\u00adta\u00adti\u00adves, and vica\u00adrious agents of Kids Con\u00adcept. Lia\u00adbi\u00adli\u00adty based on cha\u00adrac\u00adte\u00adristics or gua\u00adran\u00adtees assu\u00adred by Kids Con\u00adcept remains unaf\u00adfec\u00adted. <\/p>

      10.3 Lia\u00adbi\u00adli\u00adty of Kids Con\u00adcept for slight negli\u00adgence is only assu\u00admed inso\u00adfar as it con\u00adcerns the vio\u00adla\u00adti\u00adon of obli\u00adga\u00adti\u00adons who\u00adse ful\u00adfill\u00adment makes the pro\u00adper exe\u00adcu\u00adti\u00adon of the con\u00adtract pos\u00adsi\u00adble in the first place, who\u00adse vio\u00adla\u00adti\u00adon end\u00adan\u00adgers the achie\u00adve\u00adment of the pur\u00adpo\u00adse of the con\u00adtract, and on who\u00adse com\u00adpli\u00adance the cus\u00adto\u00admer regu\u00adlar\u00adly reli\u00ades (so-cal\u00adled car\u00addi\u00adnal obli\u00adga\u00adti\u00adons). Inso\u00adfar as the vio\u00adla\u00adti\u00adon of such essen\u00adti\u00adal con\u00adtrac\u00adtu\u00adal obli\u00adga\u00adti\u00adons is con\u00adcer\u00adned, lia\u00adbi\u00adli\u00adty for indi\u00adrect dama\u00adges, in par\u00adti\u00adcu\u00adlar pro\u00adfit and con\u00adse\u00adquen\u00adti\u00adal dama\u00adges, is excluded. <\/p>

      10.4 The abo\u00adve exclu\u00adsi\u00adons of lia\u00adbi\u00adli\u00adty do not app\u00adly to inju\u00adry to life, body, and health.<\/p>

      10.5 Kids Con\u00adcept is not respon\u00adsi\u00adble for dama\u00adges incur\u00adred within the frame\u00adwork of the care rela\u00adti\u00adonship and is the\u00adr\u00ade\u00adfo\u00adre not lia\u00adble for them. A dif\u00adfe\u00adrent rule appli\u00ades if the\u00adse were excep\u00adtio\u00adnal\u00adly cau\u00adsed by a breach of duty of the under\u00adly\u00ading pla\u00adce\u00adment agree\u00adment, in which case the lia\u00adbi\u00adli\u00adty limi\u00adta\u00adti\u00adons of Sec\u00adtions 10.2 \u2013 10.4 app\u00adly. <\/p>

      11. Miscellaneous Provisions<\/strong><\/h3>

      11.1 The law of the Fede\u00adral Repu\u00adblic of Ger\u00adma\u00adny appli\u00ades exclu\u00adsi\u00adve\u00adly, to the exclu\u00adsi\u00adon of the UN Con\u00adven\u00adti\u00adon on Con\u00adtracts for the Inter\u00adna\u00adtio\u00adnal Sale of Goods (CISG).<\/p>

      11.2 Amend\u00adments must be made in wri\u00adting.
