The com\u00adpa\u00adny Kids Con\u00adcept, owner Mr. Tobi\u00adas Drei\u00adlich, Dr.-Max Stra\u00ad\u00dfe 45, 82031 Gr\u00fcn\u00adwald, (her\u00adein\u00adaf\u00adter refer\u00adred to as \u201cKids Con\u00adcept\u201d) ope\u00adra\u00adtes a pla\u00adce\u00adment agen\u00adcy on the inter\u00adnet at the URL www.kidsconcept.de for ser\u00advices such as child\u00adca\u00adre, baby\u00adsit\u00adters, child\u00admin\u00adders, nan\u00adnies, sub\u00adsti\u00adtu\u00adte grand\u00admo\u00adthers, and child\u00adca\u00adre workers and edu\u00adca\u00adtors, and estab\u00adlishes the con\u00adnec\u00adtion bet\u00adween ser\u00advice pro\u00advi\u00adders (her\u00adein\u00adaf\u00adter care\u00adgi\u00advers) and cli\u00adents (pri\u00adva\u00adte house\u00adholds and com\u00adpa\u00adnies).<\/p>

1. Scope of Application<\/strong><\/h3>

1.1 The\u00adse Gene\u00adral Terms and Con\u00addi\u00adti\u00adons (T) app\u00adly exclu\u00adsi\u00adve\u00adly to con\u00adtrac\u00adtu\u00adal rela\u00adti\u00adonships bet\u00adween the care\u00adgi\u00adver and Kids\u00adCon\u00adcept.<\/p>

1.2 Gene\u00adral terms and con\u00addi\u00adti\u00adons of the care\u00adgi\u00adver do not app\u00adly in this con\u00adtext, regard\u00adless of whe\u00adther Kids\u00adCon\u00adcept express\u00adly objects to them.<\/p>

1.3 The T also app\u00adly to con\u00adtracts con\u00adcluded with part\u00adners from count\u00adries other than Ger\u00adma\u00adny.<\/p>

2. Conclusion of Contract \/ Registration as Caregiver<\/strong><\/h3>

2.1 The con\u00adtract is con\u00adcluded upon signa\u00adtu\u00adre of the par\u00adties on the appli\u00adca\u00adti\u00adon form.<\/p>

2.2 Befo\u00adre con\u00adclu\u00adding the agree\u00adment on regis\u00adtra\u00adti\u00adon as a care\u00adgi\u00adver, the care\u00adgi\u00adver must pro\u00advi\u00adde Kids\u00adCon\u00adcept with the requi\u00adred data and docu\u00adments. This can be done, among other ways, by com\u00adple\u00adting the non-bin\u00adding care\u00adgi\u00adver ques\u00adti\u00adon\u00adn\u00adaire on the Kids Con\u00adcept web\u00adsite at www.kids-concept.de. The appli\u00adca\u00adti\u00adon docu\u00adments must be com\u00adple\u00adte and include, in par\u00adti\u00adcu\u00adlar, cer\u00adti\u00adfi\u00adca\u00adtes, refe\u00adren\u00adces, and a poli\u00adce cle\u00adarance cer\u00adti\u00adfi\u00adca\u00adte. <\/p>

2.3 After revie\u00adw\u00ading the docu\u00adments and data and con\u00adduc\u00adting a per\u00adso\u00adnal inter\u00adview, Kids Con\u00adcept deci\u00addes whe\u00adther the respec\u00adti\u00adve care\u00adgi\u00adver will be accept\u00aded into the agen\u00adcy or not.<\/p>

2.4 Kids Con\u00adcept is under no obli\u00adga\u00adti\u00adon to accept a care\u00adgi\u00adver into its agen\u00adcy.<\/p>

3. Rights and Obligations of the Caregiver<\/strong><\/h3>

3.1. The care\u00adgi\u00adver is obli\u00adga\u00adted to pro\u00advi\u00adde Kids Con\u00adcept with all docu\u00adments and data rele\u00advant to a pla\u00adce\u00adment. Should spe\u00adcial docu\u00adments such as medi\u00adcal cer\u00adti\u00adfi\u00adca\u00adtes, work visas, or dri\u00adver\u00ad\u2019s licen\u00adses be requi\u00adred in indi\u00advi\u00addu\u00adal cases, the\u00adse must also be sub\u00admit\u00adted to Kids Con\u00adcept. <\/p>

3.2 The care\u00adgi\u00adver must ensu\u00adre that their information\/documents are com\u00adple\u00adte and accu\u00adra\u00adte.<\/p>

3.3. The care\u00adgi\u00adver is obli\u00adga\u00adted to inform Kids Con\u00adcept imme\u00addia\u00adte\u00adly of a suc\u00adcessful pla\u00adce\u00adment.<\/p>

4. Rights and Obligations of Kids Concept<\/strong><\/h3>

4.1 Kids Con\u00adcept is entit\u00adled to veri\u00adfy the docu\u00adments and data pro\u00advi\u00added by the care\u00adgi\u00adver. This includes, in par\u00adti\u00adcu\u00adlar, the right to con\u00adsult with the issuers of the documents\/references. <\/p>

4.2 Kids Con\u00adcept is under no obli\u00adga\u00adti\u00adon to place the care\u00adgi\u00adver.<\/p>

5. Costs<\/strong><\/h3>

5.1 Regis\u00adtra\u00adti\u00adon as a care\u00adgi\u00adver with Kids Con\u00adcept is free of char\u00adge.<\/p>

6. Termination<\/strong><\/h3>

6.1 The agree\u00adment on regis\u00adtra\u00adti\u00adon as a care\u00adgi\u00adver may be ter\u00admi\u00adna\u00adted by eit\u00adher par\u00adty at any time wit\u00adhout obser\u00adving a noti\u00adce peri\u00adod.<\/p>

7. Liability<\/strong><\/h3>

7.1 Kids Con\u00adcept assu\u00admes no lia\u00adbi\u00adli\u00adty for indi\u00adrect or direct dama\u00adges, unless they are based on intent or gross negli\u00adgence. This limi\u00adta\u00adti\u00adon of lia\u00adbi\u00adli\u00adty also extends to the lia\u00adbi\u00adli\u00adty of employees, legal repre\u00adsen\u00adta\u00adti\u00adves, and vica\u00adrious agents of Kids Con\u00adcept. Lia\u00adbi\u00adli\u00adty based on characteristics\/guarantees assu\u00adred by Kids Con\u00adcept or based on pro\u00adduct lia\u00adbi\u00adli\u00adty remains unaf\u00adfec\u00adted. <\/p>

7.2. Kids Con\u00adcep\u00adt\u2019s lia\u00adbi\u00adli\u00adty for simp\u00adle negli\u00adgence in prin\u00adci\u00adple is assu\u00admed extra-con\u00adtrac\u00adtual\u00adly only inso\u00adfar as it con\u00adcerns the breach of obli\u00adga\u00adti\u00adons who\u00adse ful\u00adfill\u00adment enables the pro\u00adper per\u00adfor\u00admance of the con\u00adtract in the first place, who\u00adse breach jeo\u00adpar\u00addi\u00adzes the achie\u00adve\u00adment of the con\u00adtrac\u00adtu\u00adal pur\u00adpo\u00adse, and on who\u00adse com\u00adpli\u00adance the part\u00adner regu\u00adlar\u00adly reli\u00ades (so-cal\u00adled car\u00addi\u00adnal obli\u00adga\u00adti\u00adons). Inso\u00adfar as it con\u00adcerns the breach of such con\u00adtrac\u00adtual\u00adly essen\u00adti\u00adal obli\u00adga\u00adti\u00adons, lia\u00adbi\u00adli\u00adty for indi\u00adrect dama\u00adges, in par\u00adti\u00adcu\u00adlar loss of pro\u00adfit and con\u00adse\u00adquen\u00adti\u00adal dama\u00adges, is excluded. <\/p>

7.3. Kids Con\u00adcep\u00adt\u2019s lia\u00adbi\u00adli\u00adty is fur\u00adther limi\u00adt\u00aded to dama\u00adges typi\u00adcal of the con\u00adtract that were fore\u00adseeable at the time of con\u00adtract con\u00adclu\u00adsi\u00adon and are not con\u00adtroll\u00adable by Kids Con\u00adcept. Lia\u00adbi\u00adli\u00adty for such dama\u00adges is limi\u00adt\u00aded in amount to the typi\u00adcal\u00adly fore\u00adseeable dama\u00adge. <\/p>

7.4. The abo\u00adve limi\u00adta\u00adti\u00adons of lia\u00adbi\u00adli\u00adty do not app\u00adly in the event of inju\u00adry to life, body, or health. Lia\u00adbi\u00adli\u00adty under the Pro\u00adduct Lia\u00adbi\u00adli\u00adty Act remains unaf\u00adfec\u00adted. <\/p>

8. Data Protection<\/strong><\/h3>

8.1 Kids Con\u00adcept under\u00adta\u00adkes to com\u00adply with the appli\u00adca\u00adble data pro\u00adtec\u00adtion regu\u00adla\u00adti\u00adons, in par\u00adti\u00adcu\u00adlar the pro\u00advi\u00adsi\u00adons of the Fede\u00adral Data Pro\u00adtec\u00adtion Act (BDSG) and the Tele\u00adme\u00addia Act (TMG).<\/p>

8.2 Kids Con\u00adcept is entit\u00adled, during the term of this con\u00adtract, to coll\u00adect, store, pro\u00adcess, and use the data recei\u00adved in con\u00adnec\u00adtion with the busi\u00adness rela\u00adti\u00adonship with the care\u00adgi\u00adver, to the ext\u00adent neces\u00adsa\u00adry for the ful\u00adfill\u00adment of con\u00adtrac\u00adtu\u00adal obli\u00adga\u00adti\u00adons, in par\u00adti\u00adcu\u00adlar for the pla\u00adce\u00adment of assign\u00adments.<\/p>

8.3 The care\u00adgi\u00adver has the right under the Fede\u00adral Data Pro\u00adtec\u00adtion Act to free infor\u00adma\u00adti\u00adon about the data stored about them and, if appli\u00adca\u00adble, a right to cor\u00adrec\u00adtion, blo\u00adcking, and dele\u00adti\u00adon of this data.<\/p>

8.4 Any fur\u00adther use of per\u00adso\u00adnal data bey\u00adond the afo\u00adre\u00admen\u00adtio\u00adned use requi\u00adres the sepa\u00adra\u00adte con\u00adsent of the care\u00adgi\u00adver. The care\u00adgi\u00adver is entit\u00adled to revo\u00adke their con\u00adsent at any time, inso\u00adfar as they have con\u00adsen\u00adted to the use of per\u00adso\u00adnal data. The revo\u00adca\u00adti\u00adon must be sent to Kids Con\u00adcept, owner Mr. Tobi\u00adas Drei\u00adlich, Dr.-Max Stra\u00ad\u00dfe 45, 82031 Gr\u00fcn\u00adwald.<\/p>

9. Indemnification<\/strong><\/h3>

The care\u00adgi\u00adver indem\u00adni\u00adfies Kids Con\u00adcept from all claims and holds Kids Con\u00adcept harm\u00adless from such claims that third par\u00adties assert against Kids Con\u00adcept due to the vio\u00adla\u00adti\u00adon of their rights or due to legal vio\u00adla\u00adti\u00adons based on the data\/documents pro\u00advi\u00added by the care\u00adgi\u00adver or due to con\u00adduct within the scope of the media\u00adted ser\u00advice con\u00adtract. In this regard, the care\u00adgi\u00adver also assu\u00admes the cos\u00adts of the neces\u00adsa\u00adry legal defen\u00adse of Kids Con\u00adcept, inclu\u00adding all court and att\u00ador\u00adney fees. <\/p>

10. Other Provisions<\/strong><\/h3>

10.1 The law of the Fede\u00adral Repu\u00adblic of Ger\u00adma\u00adny appli\u00ades exclu\u00adsi\u00adve\u00adly, exclu\u00adding the UN Con\u00adven\u00adti\u00adon on Con\u00adtracts for the Inter\u00adna\u00adtio\u00adnal Sale of Goods.<\/p>

10.2 The place of juris\u00addic\u00adtion for dis\u00adpu\u00adtes ari\u00adsing from the con\u00adtract is agreed bet\u00adween the par\u00adties to be the regis\u00adtered office of Kids Con\u00adcept if<\/p>

  • The care\u00adgi\u00adver has no gene\u00adral place of juris\u00addic\u00adtion in Ger\u00adma\u00adny<\/li>
  • the care\u00adgi\u00adver\u00ad\u2019s place of resi\u00addence or habi\u00adtu\u00adal resi\u00addence is unknown at the time the action is filed, or<\/li>
